1. Definitions

  • In these Terms of Use, the following definitions shall have the corresponding meaning:

WebsitesThe websites of KMG
Intellectual Property RightsCopyrights, trademark rights, database rights, trade name rights, trade secrets and any other
(intellectual) property rights
MaterialsAll texts and documents, names, logo’s, layouts, images and any other materials on the Websites or
otherwise published by KMG

2. Applicability and scope

  • These Terms of Use apply to your use of our Websites. By visiting our Websites, you agree to these Terms of Use.
  • These Terms of Use do not apply when other conditions have been declared applicable, for instance when you
    purchase any of our products or services.
  • KMG reserves the right to amend these Terms of Use at any time. The amended Terms of Use take effect at the
    moment they are published. By continuing to use the Websites, you agree to the applicability and content of
    these Terms of Use.

  • All Intellectual Property Rights to the Websites and Materials belong to KMG. All of these rights are expressly
    reserved.

    without the express consent of KMG.

  • Our Websites may contain links and other references to websites of third parties. KMG is not responsible for the
    content of such websites of third parties. We cannot give any guarantee on and cannot be held liable for the

  • You may publish links to or otherwise refer to our Websites, under the conditions that:
    • you may not make use of the Websites or Materials in violation of Article 3 of these Terms of Use;
    • you may not claim or imply that you own the Websites or Materials; and
    • you may not publish any incorrect information about KMG, the Websites or Materials.

    • infect the Websites with malware, or otherwise tamper with the Websites such as by making them
      unavailable using denial-of-service attacks;
    • in as far as the Websites contain contact forms or information, use these contact methods to send any
      unlawful information or malware to KMG; or
    • otherwise make use of the Websites and/or Materials in a manner which is unlawful or violates the rights
      of KMG.

5. Disclaimer and liability

  • KMG accepts no liability for damage of any nature arising from or in connection with the use of the Websites or
    the unavailability – temporary or otherwise – of the Websites.
  • You are fully liable for the use of the Websites and Materials, and any ensuing consequences. You are liable to
    KMG for any use of the Websites and Materials in violation of these Terms of Service.

6. Applicable law and competent court

  • These Terms of Use and your use of our Websites are governed by Dutch law.
  • Any conflict arising from these Terms of Use or your use of the Websites are exclusively submitted to the
    competent court in the district Amsterdam.
